The following General Terms and Conditions govern the manner and rules for using the website www.gaiashrooms.eu.
Definitions

Website – The online address www.gaiashrooms.eu, as well as all applications providing the customer with access to the catalog of offered items at the specified address.
Customer – Any person who visits the website and/or utilizes the Services or content thereof.
Buyer – Any customer of the Website who is 18 years old or older, has provided a delivery address within the Republic of Bulgaria, and has made a payment to the Seller.
Order – A request from the Buyer to purchase items and services selected by them, offered on the Website. To avoid any doubts – only requests with a provided delivery address within the Republic of Bulgaria are considered as orders.
Distance Contract – An order placed by the Buyer with the Seller for goods offered on the Website. To avoid any doubts – individual orders are treated as separate contracts.
Services – The provision of any electronic services by the Website to enable the Customer to communicate with the Seller and/or make purchases of the items listed in the Website’s catalog.
Promo Code – A random combination of letters, numbers, and symbols granting the Customer a fixed or percentage discount on the value of the Order. Promo codes are provided by the Seller to the Customer via email to the address specified by the Customer or through a banner on the website, valid for one calendar month.
Paid Delivery – The Buyer pays for the transport of ordered goods and services. The transport is carried out by a courier company to the address specified by the Buyer.
Courier – Orders made through the Website are delivered by the courier companies ECONT EXPRESS Ltd. and SPEEDY AD.
Order Receipt – The date on which delivery is made to the address specified by the Customer.
Basket – A virtual list of items selected by the Customer for purchase.
Final Price – All costs incurred by the Buyer for purchasing the goods, including the cost of Delivery.
General Provisions
By these General Terms and Conditions, the Seller, represented by Gaia Shrooms Ltd., declares that it complies with all applicable national regulations regarding the protection of personal data of customers and buyers and processes this personal data in accordance with its privacy policy, which you can review here.
Access to the Website may be blocked unilaterally and without notice if it is determined that the Customer is abusing the content and/or services provided on the Website.
By confirming any Order, the Buyer confirms that they have read and accept these General Terms and Conditions.
All prices in the Website’s catalog are in Bulgarian Leva for one unit of each listed item.
The Seller strives to maintain an up-to-date price list but reserves the right to renew or terminate any additional discounts/promo codes and offers at any time without notifying the Customer of each change.
Any reduction in the prices of goods is carried out by the Seller in accordance with the principles and norms of Articles 63 – 66 of the Consumer Protection Act.
The Seller adheres to all requirements of the applicable legislation regarding ensuring the compliance of goods with their description, qualities, and characteristics.
The characteristics or prices of products described on the Platform may be changed by the Seller at any time.
The Seller reserves the right to unilaterally correct and update these General Terms and Conditions without prior notice to the Customer. To avoid any doubts – by confirming each Order, the Buyer declares that they have read and accepted the published General Terms and Conditions on the Website as of the date of the Order.
The Website accepts orders only with a valid delivery address provided by the Customer within the Republic of Bulgaria.
Privacy
The Customer/User/Buyer agrees that by providing any personal or other data to the Seller, they consent to their use for the following purposes by www.gaiashrooms.eu: (1) maintaining the Customer/User/Buyer’s account, including registering orders, sending ordered products, providing ordered services, invoicing, resolving disputes with Customers/Users/Buyers regarding their Orders, or addressing their requests; (2) sending commercial communications, periodic notifications via email or SMS; (3) conducting market research, tracking and monitoring sales, and customer/user behavior.
The Customer/User/Buyer agrees to provide the Seller with unrestricted access to any materials and information they send to the Seller through or in connection with the Platform, whether or not a Purchase was made through the Platform. The Seller has no obligation to keep such information confidential unless mandated by applicable legislation.
By providing their data to www.gaiashrooms.eu (including email), the Customer/User/Buyer explicitly agrees to be contacted by www.gaiashrooms.eu or third parties such as couriers, traders, Seller partners, marketing service providers, state, municipal, or non-governmental agencies, or companies in the insurance or financial sectors, as provided by specific legislation, and other companies with which www.gaiashrooms.eu may develop joint programs for offering Goods and/or Services in the market.
Ordering Items
CONTRACT CONCLUSION
When ordering goods listed in the Website’s catalog, the Customer agrees to the General Terms and Conditions of use.
An “Order” is a request made by the customer to purchase specific items. The order is considered placed upon receipt of an automatic email from the customer, with an order number.
In case of changes in the price list of offered goods, the Seller reserves the right to cancel the orders placed, with the obligation to notify the Customer of the change and the current price of the ordered item.
The Customer agrees that saving an item on the Website and/or saving it in the “Favorites” category does not guarantee the availability of the item or the period during which the item is offered in the Website’s catalog. Accordingly, the Customer agrees that saved items will be removed from the Website’s catalog, with their status changed to “Inactive.”
In case of a systematic technical error in the price of an item, the Seller has the right to automatically cancel the placed order. In such cases, the Seller is obliged to notify the Customer by sending an automatic message to their email address.
Each order placed through the Website is treated as a separate Distance Contract between the Seller and the Buyer. To avoid any doubts – the Distance Contract is considered concluded from the moment the order is sent to the Buyer.
Orders placed on weekends and holidays are processed on the next working day.
Payments
Transportation
Goods purchased through the Website are delivered to the Buyer by the courier companies ECONT EXPRESS Ltd. or SPEEDY AD. Goods are sent to the Buyer only after the Seller has received confirmation of the placed order. After receiving confirmation from the Buyer, the Order is delivered as follows: within 3 (three) working days.
The available delivery methods are as follows:
- Delivery to a courier office;
- Delivery to an address specified by the Customer.
Orders sent to an office will be held at the courier's office for no more than 7 (seven) days. After this period, the Seller has the right to cancel the Order without explicitly notifying the Customer.
For Orders delivered to an address, the Customer must provide access and the possibility to receive the Order. If the Customer is not found at the specified address, the Seller reserves the right to cancel the Order or leave it at the nearest courier office, with the goods remaining at the office for no longer than 7 (seven) days, after which the Order is considered canceled, and the goods are returned to the Seller.
Order Cancellation and Return of Goods
For a Customer who has refused to pay for an Order with cash on delivery more than 2 (two) times, the Seller has the right to cancel the respective Order without explicitly notifying the Customer.
The Buyer may cancel a confirmed Order in the following manner:
- Notify of cancellation via a phone call to the number provided in Contacts within 1 (one) hour after placing the Order.
- Notify of cancellation via email to the address provided in Contacts within 1 (one) hour after placing the Order.
The Buyer has the right to cancel the Order if the packaging and the goods within it are damaged during transportation. To avoid any doubts – if the packaging is damaged but the goods are not damaged, the Buyer does not have the right to invoke this clause.
For goods sold by www.gaiashrooms.eu, there is a statutory guarantee of conformity in accordance with the Consumer Protection Act, which guarantee for different types of goods complies with the minimum warranty periods valid for the respective type of goods within the European Union.

With these "General Terms and Conditions," the Seller aims to inform the Buyer that as a consumer, they have the option to contact the local ADR (Alternative Dispute Resolution) body in connection with a dispute that they have been unable to resolve directly with the Seller.

ADR is a procedure for out-of-court resolution of domestic and cross-border disputes related to contractual obligations arising from sales contracts or service contracts between a trader established in the Union and a consumer residing in the Union, through the intervention of a dispute resolution body that offers or imposes a solution or brings together the parties to facilitate reaching a mutually agreed resolution.
